Musharraf hanging case: The decision of the special court is upheld, the Supreme Court

Islamabad: In the hearing of the Musharraf treason case, Supreme Court Justice Athar Minallah stated that the decision of the special court stands.

The federal government maintains that it does not support the decision of the special court to declare the former president Pervez Musharraf’s trial in the treason case void.

The Supreme Court, in the hearing related to the appeal against the Lahore High Court’s decision regarding the trial of former President Pervez Musharraf in the treason case, granted the counsel another week to seek instructions from the Musharraf family.

A four-member bench, headed by Chief Justice Gulzar Ahmed, conducted the hearing.

Musharraf’s lawyer, Salman Safdar, appeared and informed the court that when the former president was alive, they were in contact, and he wished for his appeal to be heard. Attempts were made to contact Musharraf’s family 8 to 10 times, but no instructions for filing the appeal have been received yet. I do not want to pursue these appeals.

Justice Athar Minallah said that Salman Safdar’s actions will have implications for the future generations. The pension and other perks of Pervez Musharraf will also be affected.

The lawyer stated that Musharraf’s family wanted to pursue the appeal, but they needed another week to contact them. The court accepted the lawyer’s request for more time.

The Supreme Court also heard the appeal against the Lahore High Court’s decision in the case of high treason, which was heard by the special court in the Musharraf case.

The Additional Attorney General appeared and stated that the federal government does not support the Lahore High Court’s decision.

The Chief Justice asked if you support the decision against the federal court? The Additional Attorney General replied that he did not want to use the term “support.”

Justice Mansoor Ali Shah inquired if you are not defending the Lahore High Court’s decision? The Additional Attorney General replied that we are not defending the Lahore High Court’s decision.

Justice Athar Minallah said that even after the Lahore High Court’s decision, the decision of the special court is still in force.

During the hearing, Chief Justice raised questions about how the Lahore High Court wrote the application and whether there are any questions about the filing and settlement of the application after the objections of the registrar. How was the case assigned to the single bench and then to the three-member bench? Hammad Khan should also look into this matter and assist on it. Later, the court adjourned the hearing until 11:30 AM on Wednesday.
